By accessing or using our Service, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

By creating an account, accessing, or using hybrED.ai, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the Service on behalf of an organization or if you are a parent or guardian registering a minor, you represent that you have the authority to bind that organization or minor to these Terms.

2. Eligibility and Age Requirements

2.1 General Eligibility

hybrED.ai is designed for K-12 students and educational purposes. Users of all ages may access the Platform, subject to the parental consent requirements described below.

2.2 Children Under 13 (COPPA Compliance)

In compliance with the Children's Online Privacy Protection Act (COPPA), children under 13 years of age may only use hybrED.ai with verifiable parental consent. Parents or legal guardians must:

• Create and manage accounts for children under 13
• Provide verifiable consent before any personal information is collected from their child
• Maintain the right to review, delete, or refuse further collection of their child's information at any time

2.3 Users Ages 13-17

Users between 13 and 17 years of age may create accounts with parental or guardian awareness and consent. We encourage parents and guardians to monitor their teen's use of the Platform.

Unlike traditional AI tutoring services, our platform guides students through thoughtful questioning rather than providing direct answers, fostering deeper understanding and analytical skills.

4.2 AI-Generated Content Disclaimer

Our Service uses artificial intelligence to generate educational content and responses. While we strive for accuracy, AI-generated content may occasionally contain errors or inaccuracies. The Platform is designed to supplement, not replace, traditional education and should not be relied upon as the sole source of educational instruction. Users should verify important information through additional sources when necessary.

4.3 Safety Monitoring Features

hybrED.ai includes AI-powered safety monitoring features designed to detect potential mental health concerns, signs of distress, or crisis situations in student communications. When such concerns are identified, the system may alert designated contacts (parents, guardians, or school administrators as applicable) via the phone number provided during registration. By using our Service, you consent to this monitoring for safety purposes. This feature is not a substitute for professional mental health services.

5. Subscription and Payment Terms

5.1 Subscription Plans

hybrED.ai offers various subscription tiers with different features and pricing. Current subscription options and pricing are available on our website. We reserve the right to modify subscription offerings and pricing with reasonable notice to existing subscribers.

5.2 Payment Processing

All payments are processed securely through Stripe, Inc. ("Stripe"). By making a purchase, you agree to Stripe's terms of service and privacy policy. We do not store complete credit card information on our servers.

5.3 Automatic Renewal

Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date. You may cancel your subscription at any time through your account settings.

5.4 Refund Policy

6. "Win While You Learn" Rewards Program

hybrED.ai offers a rewards program where students can earn points through educational engagement.

• Points may be redeemed for various rewards as described on the Platform
• Points have no cash value and cannot be transferred or sold
• We reserve the right to modify, suspend, or terminate the rewards program at any time
• Any accumulated points may expire if not used within the timeframe specified in the program rules
• Abuse of the rewards system may result in forfeiture of points and account termination

7. The 6% Pledge Scholarship Initiative

7.1 Our Commitment

hybrED.ai is committed to making quality education accessible to all students. Through our 6% Pledge, we dedicate six percent (6%) of our revenue to fund scholarships that provide free or reduced-cost access to the hybrED.ai platform for students who demonstrate financial need.

7.2 Scholarship Eligibility

Scholarships funded through the 6% Pledge are available to students who demonstrate financial need through an application process. Eligibility criteria, application procedures, and selection processes are published on our website and may be updated periodically. Scholarship recipients are selected at hybrED.ai's sole discretion based on available funds and applicant qualifications.

7.3 Program Terms

The 6% Pledge represents a voluntary commitment by hybrED.ai and does not create any legal obligation, entitlement, or guarantee of scholarship funding. We reserve the right to modify, suspend, or discontinue the 6% Pledge program at any time. Scholarship awards are subject to availability of funds and program requirements. Participation in the scholarship program requires agreement to additional terms and conditions specific to the scholarship.

8. User Conduct and Acceptable Use

You agree to use hybrED.ai only for lawful educational purposes. You may not:

• Attempt to circumvent the Socratic Method teaching approach to obtain direct answers
• Use the Service to complete assignments dishonestly or violate academic integrity policies
• Share account credentials with others
• Attempt to access, probe, or test the vulnerability of our systems
• Use automated means to access the Service without permission
• Harass, abuse, or harm other users
• Upload malicious code or interfere with the Platform's functionality
• Use the Service for any commercial purpose without authorization

9. Intellectual Property

9.1 Our Intellectual Property

hybrED.ai and all associated trademarks, logos, content, software, and materials are owned by Wonder Monkey AI LLC or its licensors. You receive a limited, non-exclusive, non-transferable license to use the Service for personal, educational purposes only.

9.2 User Content

You retain ownership of content you submit to the Platform. By submitting content, you grant us a non-exclusive, royalty-free license to use, store, and process that content to provide and improve our Service. We may use anonymized and aggregated data derived from user interactions to improve our AI models and educational effectiveness.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE. WE DO NOT GUARANTEE ANY SPECIFIC EDUCATIONAL OUTCOMES. THE SAFETY MONITORING FEATURE IS NOT A SUBSTITUTE FOR PROFESSIONAL MENTAL HEALTH SERVICES, AND WE DO NOT GUARANTEE DETECTION OF ALL CONCERNING COMMUNICATIONS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WONDER MONKEY AI LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless Wonder Monkey AI LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

13. Termination

We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion. You may terminate your account at any time by contacting us. Upon termination, your right to use the Service ceases immediately, and we may delete your data in accordance with our Privacy Policy.

14. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Platform. Continued use of the Service after changes become effective constitutes acceptance of the modified Terms.

15. Governing Law and Dispute Resolution

These Terms constitute the entire agreement between you and Wonder Monkey AI LLC regarding the Service. If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce any right does not waive that right. You may not assign these Terms without our consent.
